Terms and Conditions of Use

Welcome to ArtHeart, a platform operated by Art Heart Entertainment LLC (“ArtHeart,” “we,” “our,” or “us”), designed to connect artists and fans through meaningful collectible and digital experiences. By accessing or using the ArtHeart app, website, or any affiliated product, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not access or use our services.

1. Definitions

  • “ArtHeart” means Art Heart Entertainment LLC, its affiliates, employees, successors, and assigns.
  • “User” means any individual or organization using the ArtHeart app or website.
  • “Artist” means any User who creates, uploads, or distributes artistic content through ArtHeart.
  • “a.cube” means a physical collectible that provides digital streaming access to exclusive content via NFC or similar technology.
  • “Content” means all artworks, media, data, text, images, audio, video, and information made available within the ArtHeart ecosystem.

2. Eligibility and Account Use

You must be at least 13 years old (or the minimum legal age in your jurisdiction) or have verified parental consent to use ArtHeart.

You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

You agree not to:

  • Misuse, hack, or disrupt the platform;
  • Attempt to access data not intended for you;
  • Copy, scrape, or reverse-engineer any part of the service.

3. Artist Rights and Responsibilities

Artists retain full copyright and ownership of their creative works unless explicitly transferred in writing.By uploading or publishing content, Artists grant ArtHeart a limited, non-exclusive, royalty-free, worldwide license to:

  • Host, stream, and display their content within the platform;
  • Use excerpts or visuals for promotional and marketing purposes connected to ArtHeart.

Artists are solely responsible for ensuring that their content does not infringe on any third-party intellectual property or other legal rights.ArtHeart reserves the right to remove or restrict access to any content reported as infringing or illegal.

4. Collectibles and the a.cube Experience

Each a.cube may provide access to exclusive digital content tied to a specific Artist or edition.

Users are responsible for the safekeeping of their physical collectibles.

ArtHeart may, at its discretion, replace defective a.cubes within a reasonable warranty period but assumes no responsibility for loss, theft, or damage caused by user negligence.

The a.cube does not constitute a storage device; all content is hosted on ArtHeart servers.

5. Purchases, Subscriptions, and Payments

All purchases, including collectibles and subscriptions, are final unless otherwise specified by ArtHeart.

Subscription plans automatically renew unless canceled prior to renewal.

Prices and payment terms are subject to change, with reasonable prior notice for existing subscribers.

Payments are processed via third-party providers, and Users agree to their respective terms.

ArtHeart is not responsible for payment errors or disputes arising from third-party systems.

6. Intellectual Property

All trademarks, designs, software, and proprietary technology used by ArtHeart are owned by Art Heart Entertainment LLC and protected by international copyright laws.

You may not copy, distribute, reverse-engineer, or create derivative works from the ArtHeart platform or content without prior written consent.

User-submitted content remains the sole property of the Artist but is licensed to ArtHeart as described in Section 3 “a.services”.‍

7. Streaming-Only Service

ArtHeart operates exclusively as a streaming-only platform.

Access to music, video, or other media on ArtHeart grants Users a personal, non-commercial license to stream content within the platform.

It does not grant any ownership, reproduction, download, or resale rights.

All copyrights remain with the original Artist or rights holder.

8. a.cube as a Streaming Key

The a.cube serves solely as a streaming access key to its corresponding digital edition hosted on ArtHeart.

Owning an a.cube does not transfer copyright, reproduction, or commercial rights.

It functions purely as a collectible and gateway to the Artist’s digital experience.‍

9. No Resale or Redistribution Rights

Users may not resell, duplicate, redistribute, or make available any ArtHeart-linked content, whether accessed via the app or through an a.cube.

Unauthorized use or duplication may result in immediate account suspension and potential legal action.

10. Clarification of Physical vs. Digital Goods

Physical items (such as a.cubes) are collectible access tools, not physical carriers of copyrighted works.

All media linked through ArtHeart is digital streaming content.

Purchasing an a.cube or digital license does not imply ownership of the underlying creative work.

11. Limitation of Liability

ArtHeart provides its services “as is” and “as available” without warranties of any kind.

To the fullest extent permitted by law, ArtHeart disclaims all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

ArtHeart shall not be liable for:

  • Any indirect, incidental, or consequential damages;
  • Loss of profits, data, or goodwill;
  • Misunderstanding of ownership or rights to streamed content.

Users acknowledge that access to ArtHeart does not confer ownership rights to any content.

12. Termination

ArtHeart may suspend or terminate accounts that violate these Terms or engage in fraudulent, harmful, or abusive conduct.

Users may delete their accounts at any time. Some information may be retained as required by law.

13. Modifications to Terms

ArtHeart reserves the right to modify these Terms at any time.

Updated Terms will be published on the platform and take effect immediately.

Continued use constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States.

All disputes shall be resolved under the exclusive jurisdiction of Wyoming courts.

ArtHeart Privacy Policy

This Privacy Policy explains how Art Heart Entertainment LLC (“ArtHeart,” “we,” “us,” or “our”) collects, uses, processes, stores, and protects personal information when you access or use the ArtHeart application, website, and related services (collectively, the “Services”).

1. Information We Collect

We collect and process only the information reasonably necessary to provide, operate, secure, and maintain the Services.

Depending on how you use ArtHeart, this may include the following categories of information.

Account Information

When you create or manage an ArtHeart account, we may collect:

  • Email address;
  • Display name or username;
  • Profile image;
  • Biography or other profile information you voluntarily provide;
  • Information associated with your account and account preferences.

Artists may also provide profile information, content, media, and other materials necessary to create and manage their presence on ArtHeart.

Authentication Information

ArtHeart uses your email address to authenticate your account, including by sending one-time verification codes (OTP).

Information relating to authentication requests and verification status may be processed where necessary to provide and secure access to your account.

Transaction and Purchase Information

When you purchase a product, subscribe to an Artist, or otherwise complete a transaction through ArtHeart, we may receive information associated with the transaction, including:

  • Product or subscription purchased;
  • Transaction amount and currency;
  • Transaction status;
  • Order or transaction identifier;
  • Subscription status and relevant dates;
  • Shipping information where required to deliver a physical product;
  • Limited information about the payment method used.

ArtHeart does not collect or store full payment card numbers, card security codes (CVV/CVC), or complete bank account credentials.

Payments are processed by Stripe. Supported payment methods made available through Stripe may include Apple Pay.

Stripe and applicable payment providers process payment information according to their own privacy policies and security requirements.

Technical Information

Certain technical information may be processed automatically as necessary to deliver, secure, and maintain the Services, including:

  • IP address;
  • Device type;
  • Operating system;
  • Browser or WebView information;
  • Application version;
  • Date and time of access;
  • Server and network logs;
  • Requested pages or resources;
  • Error and diagnostic information; and
  • Security-related information.

ArtHeart uses web-based technologies, including WebView technology within its mobile applications. As a result, certain technical information may be processed in substantially the same way as when accessing a website through a web browser.

This information is used for technical operation, security, troubleshooting, fraud prevention, and maintenance of the Services.

Communications

If you contact ArtHeart for customer support, technical assistance, privacy matters, or other requests, we may retain your communication and the information reasonably necessary to respond to it.

2. Analytics, Advertising and Tracking

ArtHeart does not currently use third-party behavioral analytics, advertising pixels, session-recording tools, or cross-site or cross-app tracking technologies to monitor Users for advertising or behavioral profiling purposes.

We do not use personal information for targeted or behavioral advertising.

ArtHeart does not sell personal information.

This does not include technical information necessarily processed by our hosting, network, security, authentication, or payment infrastructure for purposes such as delivering the Services, protecting accounts, preventing fraud, maintaining security, or completing transactions.

If our use of analytics or tracking technologies materially changes in the future, this Privacy Policy will be updated accordingly.

3. How We Use Personal Information

We may use personal information to:

  • Create, authenticate, and manage User and Artist accounts;
  • Send authentication and verification messages, including OTP codes;
  • Provide access to ArtHeart features and Artist content;
  • Operate Artist profiles and related services;
  • Manage subscriptions and purchases;
  • Process and maintain transaction and order records;
  • Fulfill and deliver physical products where applicable;
  • Provide customer and technical support;
  • Send important account, transaction, security, and service-related communications;
  • Maintain and protect the security and integrity of ArtHeart;
  • Detect and prevent fraud, abuse, unauthorized access, and other harmful activity;
  • Diagnose technical problems and maintain the functionality and performance of the Services;
  • Enforce applicable terms and policies; and
  • Comply with applicable legal, tax, accounting, regulatory, and other legal obligations.

Where required by applicable law, ArtHeart relies on an appropriate legal basis for processing personal information. Depending on the circumstances, this may include:

  • Performance of a contract with you;
  • Compliance with a legal obligation;
  • Our legitimate interests in operating, maintaining, and securing the Services; or
  • Your consent, where consent is required.

4. Service Providers

ArtHeart uses third-party service providers that help us operate and provide the Services.

Our current primary service providers include:

Cloudflare

We use Cloudflare for network infrastructure, content delivery, performance, and security-related services.

In providing these services, Cloudflare may process technical information such as IP addresses, network traffic information, routing information, and security-related data.

DigitalOcean

We use DigitalOcean for cloud hosting and infrastructure used to operate ArtHeart and store or deliver application data and content.

Mailjet

We use Mailjet to send authentication and transactional emails, including one-time verification codes (OTP).

For this purpose, Mailjet may process information necessary to deliver the message, including your email address and technical information associated with email delivery.

Stripe

We use Stripe to process payments and payment-related transactions and subscriptions.

Stripe processes payment information directly. ArtHeart does not store full payment card numbers or card security codes.

Depending on the payment method selected, Stripe may make payment options such as Apple Pay available to Users.

ArtHeart may receive limited transaction and payment-method information from Stripe where necessary to confirm, manage, or support a purchase or subscription.

5. How We Share Personal Information

We do not sell personal information.

Personal information may be disclosed only where reasonably necessary to:

  • Provide and operate the Services;
  • Process payments, purchases, and subscriptions;
  • Send authentication or service-related communications;
  • Host and deliver ArtHeart content;
  • Fulfill physical product orders;
  • Protect the security and integrity of the Services;
  • Prevent fraud, abuse, or unauthorized activity;
  • Comply with applicable law, regulation, court orders, or valid legal requests; or
  • Protect the rights, property, or safety of ArtHeart, our Users, Artists, or others.

Service providers that process personal information on our behalf are expected to use such information only for providing the relevant services or as otherwise permitted or required by applicable law.

If ArtHeart undergoes a merger, acquisition, restructuring, financing, sale of assets, or similar corporate transaction, information may be transferred as part of that transaction, subject to applicable law and appropriate privacy protections.

6. International Data Transfers

Art Heart Entertainment LLC is a United States company, and some of our service providers may process information in the United States, European Union, or other countries.

As a result, personal information may be transferred to or processed in a country other than the country in which you reside.

Where required by applicable data protection law, we use or require appropriate safeguards for international transfers of personal information.

7. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention periods may depend on the type of information, the reason it was collected, and applicable legal requirements.

Certain information may be retained where necessary to:

  • Maintain your account;
  • Provide purchased products or subscriptions;
  • Maintain transaction, accounting, and tax records;
  • Comply with legal or regulatory obligations;
  • Resolve disputes;
  • Enforce agreements;
  • Prevent fraud or abuse; or
  • Protect the security and integrity of the Services.

If you delete your account or submit a valid deletion request, eligible personal information will be deleted or anonymized within a reasonable period, subject to applicable legal obligations and legitimate retention requirements.

Certain information may remain temporarily in backups or archival systems until it is deleted through normal backup and retention processes.

8. Data Security

ArtHeart uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, destruction, or misuse.

Access to systems containing personal information is restricted to persons and service providers that require such access for legitimate operational purposes.

However, no electronic transmission, network, or data-storage system can be guaranteed to be completely secure.

9. Your Privacy Rights

Depending on where you live and the laws applicable to you, you may have certain rights regarding your personal information.

These rights may include the right to:

  • Request information about how your personal information is processed;
  • Request access to personal information we hold about you;
  • Request correction of inaccurate or incomplete information;
  • Request deletion of your personal information;
  • Request restriction of certain processing;
  • Object to certain processing;
  • Request a portable copy of certain personal information;
  • Withdraw consent where processing is based on consent; and
  • Lodge a complaint with an applicable data protection authority.

Some rights may be subject to applicable legal limitations, exemptions, or retention requirements.

We may need to verify your identity before completing certain privacy requests.

ArtHeart will not discriminate against Users for exercising privacy rights available to them under applicable law.

10. Account Deletion

You may request deletion of your ArtHeart account through account-management functionality made available by ArtHeart or by contacting:

Deleting an account may result in the loss of access to content, subscriptions, account history, purchases, or other features associated with the account.

Certain information may continue to be retained where necessary to comply with applicable law, maintain required transaction and financial records, prevent fraud, resolve disputes, enforce agreements, or protect the security of the Services.

11. Children’s Privacy

ArtHeart is not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13.

If we become aware that personal information has been collected from a child under 13 without legally required authorization, we will take reasonable steps to delete that information.

Users must also satisfy any higher minimum-age or parental-authorization requirements that apply under the laws of their country or region.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to ArtHeart, our Services, data practices, service providers, or applicable legal requirements.

When this Privacy Policy is updated, the “Last updated” date at the top of the Policy will be revised.

Where required by applicable law, we will provide additional notice of material changes or obtain consent before applying changes that require consent.

14. Governing Law

To the extent permitted by applicable law, this Privacy Policy is governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Nothing in this Privacy Policy limits any mandatory privacy, data-protection, or consumer-protection rights available to you under the laws of your country, state, or region.
